Asset forfeiture is a law enforcement tool that is designed to recover real and personal property that has been gained from or used in crime. Forfeiture laws are some of the oldest laws in the United States. Although the Kansas Legislature has of late amended some of the processes making the government's efforts more difficult, forfeiture law remains a very effective means to combat certain criminal activity.
This basic course reviews the public policies, statutory process, constitutional use, and the practical administrative decision-making necessary in civil forfeiture investigations. It will also examine the different types of state and federal forfeiture, protections for property owners, and the recognized defenses to forfeiture.
